All the Products sold are covered by the legal guarantee of conformity provided for by art. 128-135 of the Consumer Code (“Legal Guarantee”).
As required by law, the guarantee on products sold by Giostyle SpA varies according to whether the Customer is a Consumer or a Professional (by Consumer we mean the Customer who does not make the purchase in the context of his own entrepreneurial, commercial, artisan activity) .
If the customer turns out to be a consumer, he benefits from the “legal guarantee of conformity” to which the seller is required by law on all goods sold. The Customer will have the right to restore the conformity of the goods free of charge by repair or replacement, or, if this is not possible, to a reduction in the purchase price or termination of the contract. Giostyle SpA is liable for lack of conformity only if they occur within 2 years from the date of delivery of the goods to the Consumer.
In case of receipt of Products that do not comply with the Sales Agreement, pursuant to articles 129 and ss. of the Consumer Code, the Customer loses all rights if he does not report the lack of conformity to Giostyle SpA within 2 months from the date on which the defect was discovered. In the event of a compliance problem, the Customer may request the repair and / or replacement of the Product, or a reduction in the price or the termination of the Sales Agreement, unless the request is objectively impossible to satisfy or is for Giostyle SpA excessively burdensome pursuant to art. 130, paragraph 4 of the Consumer Code.
The request must be sent via the reserved area by accessing the RETURNS section, in the same communication, where the Customer’s request has been accepted, Giostyle SpA must indicate the methods of shipment or return of the Product as well as the deadline for the return or replacement of the good bad. If the repair and replacement are impossible or excessively expensive, or Giostyle SpA has not repaired or replaced the Product / s within the term referred to in the previous point or, finally, the replacement or repair previously carried out has caused significant inconvenience to the customer, the latter may request, at his choice, a reasonable reduction in the price or the termination of the sales contract. In this case, the Customer must send his request to Giostyle SpA which will indicate his willingness to proceed with it, or the reasons that prevent him from doing so, within 7 working days of receipt.
